Many members of the XRP Army interpreted this as good news, with some suggesting this may have marked the end of the case.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">A thorough look <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.sec.gov\/enforcement-litigation\/litigation-releases?populate=ripple&amp;year=All&amp;month=All\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"external\"><span data-preserver-spaces=\"true\">shows<\/span><\/a><span data-preserver-spaces=\"true\"> that the legal action has indeed <\/span><span data-preserver-spaces=\"true\">been deleted<\/span><span data-preserver-spaces=\"true\"> from the regulator\u2019s \u201cLitigation Releases<\/span><span data-preserver-spaces=\"true\">\u201c<\/span><span data-preserver-spaces=\"true\"> section. However, the popular US attorney Jeremy Hogan cleared the air by <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/x.com\/attorneyjeremy1\/status\/1884304469183324502\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"external\"><span data-preserver-spaces=\"true\">saying<\/span><\/a><span data-preserver-spaces=\"true\"> that the Ripple v. SEC battle remains visible on the <\/span><span data-preserver-spaces=\"true\">actual<\/span><span data-preserver-spaces=\"true\"> appellate court website.\u00a0<\/span><\/p>\n<blockquote>\n<p><span data-preserver-spaces=\"true\">\u201cIt\u2019s still there, and nothing new has <\/span><span data-preserver-spaces=\"true\">been filled<\/span><span data-preserver-spaces=\"true\">,\u201d he added.<\/span><\/p>\n<\/blockquote>\n<p><span data-preserver-spaces=\"true\">The lawsuit dates back <\/span><span data-preserver-spaces=\"true\">to December 2020<\/span><span data-preserver-spaces=\"true\"> when the Commission accused Ripple and some of its executives of raising over $1.3 billion through an unregistered securities offering by selling XRP tokens.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The entities threw multiple punches at each other in the following years, and some believe the company currently has the upper hand. After all, the SEC is no longer led by the former anti-crypto Chairman Gary Gensler. He <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/cryptopotato.com\/gary-gensler-officially-out-what-does-it-mean-for-ripple-xrp\/\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\"><span data-preserver-spaces=\"true\">resigned<\/span><\/a><span data-preserver-spaces=\"true\"> on January 20 (the day of Donald Trump\u2019s inauguration) and was replaced by Mark Uyeda, who has a much more positive stance toward the digital asset industry.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Additionally, Ripple has secured some vital (yet partial) court wins. For instance, Judge Torres <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/cryptopotato.com\/xrp-price-explodes-16-as-judge-rules-in-favor-of-ripple-in-sec-case\/\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\"><span data-preserver-spaces=\"true\">ruled<\/span><\/a><span data-preserver-spaces=\"true\"> in 2023 that the firm\u2019s XRP sales on crypto exchanges did not constitute securities transactions. The SEC officially <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/cryptopotato.com\/sec-provides-details-with-last-minute-appeal-in-ripple-xrp-ruling\/\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\"><span data-preserver-spaces=\"true\">appealed<\/span><\/a><span data-preserver-spaces=\"true\"> that verdict in October 2024, prolonging the case indefinitely.\u00a0<\/span><\/p>\n<h2><span data-preserver-spaces=\"true\">The Possible Outcome Scenarios<\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">Earlier this month, US attorney John Deaton (who represents thousands of XRP investors in the lawsuit against the SEC) observed the latest developments in the legal tussle and <a href=\"https:\/\/cryptopotato.com\/pro-xrp-attorney-outlines-3-possible-scenarios-for-the-ripple-v-sec-lawsuit\/\" data-wpel-link=\"internal\">outlined<\/a> three potential options for a final resolution. The first one involves continuing the regulator\u2019s appeal.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The second is a dismissal of the plea, which would require Ripple to pay a previously ordered penalty of $125 million. Last summer, Judge Torres <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/cryptopotato.com\/ripple-fined-125m-in-lawsuit-against-sec-xrp-price-soars-20-immediately\/\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\"><span data-preserver-spaces=\"true\">ruled<\/span><\/a><span data-preserver-spaces=\"true\"> that the firm must settle the amount due to violating certain rules.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Some of Ripple\u2019s executives were more than pleased to do so, considering that the fine represented a fraction of the $2 billion the SEC initially insisted on.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Deaton\u2019s third scenario (which seems most unlikely) includes the SEC withdrawing its appeal and scrapping the firm\u2019s $125 million fine.<\/span><\/p>\n<blockquote>\n<p><span data-preserver-spaces=\"true\">\u201cI don\u2019t see the SEC saying: \u201cNo, we\u2019re going to deny a judge\u2019s ruling.<\/span><span data-preserver-spaces=\"true\">\u201c<\/span><span data-preserver-spaces=\"true\"> So that\u2019s why I think the middle one is the option,<\/span><span data-preserver-spaces=\"true\">\u201c<\/span><span data-preserver-spaces=\"true\"> the lawyer concluded.<\/span><\/p>\n<\/blockquote>\n<p>The post <a href=\"https:\/\/cryptopotato.com\/ripple-v-sec-case-over-xrp-holders-confused-by-new-twist\/\" rel=\"nofollow\">Ripple v.
