In mid-January, the securities regulator officially <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/cryptopotato.com\/ripple-v-sec-case-takes-new-turn-agency-appeals-2023-decision-whats-next\/\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\"><span data-preserver-spaces=\"true\">filed<\/span><\/a><span data-preserver-spaces=\"true\"> its first opening brief as part of its appeal against a court decision concerning the XRP sold on exchanges years ago. It also insisted (once again) that Ripple\u2019s native token should <\/span><span data-preserver-spaces=\"true\">be classified<\/span><span data-preserver-spaces=\"true\"> as a security. A week later, Ripple <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/x.com\/FilanLaw\/status\/1882765054053163328\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"external\"><span data-preserver-spaces=\"true\">requested<\/span><\/a><span data-preserver-spaces=\"true\"> a due date of April 16, 2025, for its brief.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The SEC\u2019s appeal concerns Judge Torres\u2019 <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/cryptopotato.com\/xrp-price-explodes-16-as-judge-rules-in-favor-of-ripple-in-sec-case\/\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\"><span data-preserver-spaces=\"true\">ruling<\/span><\/a><span data-preserver-spaces=\"true\"> from August 2023 when she found that the firm\u2019s programmatic sales of XRP to retail clients through centralized exchanges did not breach the rules.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">And while the crypto industry has <\/span><span data-preserver-spaces=\"true\">largely sided<\/span><span data-preserver-spaces=\"true\"> with Ripple in the lawsuit, some financial entities have voiced support for the Commission. On January 22, the non-profit organization Better Markets <a href=\"https:\/\/cryptopotato.com\/better-markets-files-amicus-brief-backing-sec-in-ripple-case\/\" data-wpel-link=\"internal\">categorized<\/a> XRP as a security.<\/span><\/p>\n<blockquote>\n<p><span data-preserver-spaces=\"true\">\u201cThe XRP tokens sold by Ripple Labs, Inc. (\u201cRipple\u201d) are investment contract securities regardless of whether investors acquired them directly from Ripple or indirectly on secondary trading platforms.<\/span><\/p>\n<p>And they are investment contracts regardless of the purchasers\u2019 level of sophistication. In all cases, <span data-preserver-spaces=\"true\">investors were led<\/span><span data-preserver-spaces=\"true\"> to expect profits from the efforts of others, thus satisfying the third prong of the Howey test for investment contracts,\u201d the brief reads.\u00a0<\/span><\/p>\n<\/blockquote>\n<h2><span data-preserver-spaces=\"true\">Gensler\u2019s Departure<\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">An important event that may impact the Ripple v. SEC case is Gary Gensler\u2019s resignation as a <\/span><span data-preserver-spaces=\"true\">Chairman of the watchdog<\/span><span data-preserver-spaces=\"true\">. He <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/cryptopotato.com\/gary-gensler-officially-out-what-does-it-mean-for-ripple-xrp\/\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\"><span data-preserver-spaces=\"true\">stepped down<\/span><\/a><span data-preserver-spaces=\"true\"> on January 20 (the day of Donald Trump\u2019s inauguration) and <\/span><span data-preserver-spaces=\"true\">was replaced<\/span><span data-preserver-spaces=\"true\"> by the pro-crypto Mark Uyeda.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Gensler was considered a huge enemy of the crypto sector, and the XRP army interpreted the shifts in the SEC\u2019s leadership as something that could lead to a potentially favorable resolution for Ripple.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">One person who<\/span> <a class=\"editor-rtfLink\" href=\"https:\/\/cryptopotato.com\/pro-xrp-attorney-outlines-3-possible-scenarios-for-the-ripple-v-sec-lawsuit\/\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\"><span data-preserver-spaces=\"true\">presented<\/span><\/a><span data-preserver-spaces=\"true\"> three possible outcome scenarios following the changes <\/span><span data-preserver-spaces=\"true\">is the American attorney John Deaton<\/span><span data-preserver-spaces=\"true\">.<\/span><span data-preserver-spaces=\"true\"> First, he assumed that the SEC might stand by its appeal, thus prolonging the battle indefinitely. <\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Second, he suggested that the regulator could dismiss the plea and insist that Ripple pay the previously ruled penalty of $125 million. Last summer, Judge Torres <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/cryptopotato.com\/ripple-fined-125m-in-lawsuit-against-sec-xrp-price-soars-20-immediately\/\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\"><span data-preserver-spaces=\"true\">ordered<\/span><\/a><span data-preserver-spaces=\"true\"> the company to settle the amount due to violating certain rules.
