Recall that it all started in December 2020 when the agency sued the company and some of its executives over allegations of conducting an unregistered securities offering by selling XRP.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Ripple secured some partial court victories in the past few years, <\/span><span data-preserver-spaces=\"true\">which seemingly tipped<\/span><span data-preserver-spaces=\"true\"> the scales in its favor. The case was close to its official resolution in August 2024 when Judge Analisa Torres\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/cryptopotato.com\/ripple-fined-125m-in-lawsuit-against-sec-xrp-price-soars-20-immediately\/\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\"><span data-preserver-spaces=\"true\">ordered<\/span><\/a><span data-preserver-spaces=\"true\"> the firm to pay a $125 million civil penalty for violating federal securities laws through its institutional sales of XRP.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Ripple was ready to settle the fine (which represented just a fraction of the $2 billion the SEC initially asked for)<\/span><span data-preserver-spaces=\"true\">, but the<\/span><span data-preserver-spaces=\"true\"> Commission <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/cryptopotato.com\/sec-provides-details-with-last-minute-appeal-in-ripple-xrp-ruling\/\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\"><span data-preserver-spaces=\"true\">appealed<\/span><\/a><span data-preserver-spaces=\"true\"> a 2023 verdict set by the same judge, thus prolonging the case indefinitely.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">According to some legal experts<\/span><span data-preserver-spaces=\"true\">, though<\/span><span data-preserver-spaces=\"true\">, a settlement might happen in the following months.<\/span><span data-preserver-spaces=\"true\"> The popular American attorney Jeremy Hogan recently <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/x.com\/attorneyjeremy1\/status\/1888944878119211397\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"external\"><span data-preserver-spaces=\"true\">claimed<\/span><\/a><span data-preserver-spaces=\"true\"> that such a development is <\/span><span data-preserver-spaces=\"true\">more<\/span><span data-preserver-spaces=\"true\"> likely to come before the potential approval of a spot XRP ETF in the US.\u00a0<\/span><\/p>\n<blockquote>\n<p><span data-preserver-spaces=\"true\">\u201cNot because it has to happen in that order, but because the ETFs will just take longer to dot the i\u2019s and cross the t\u2019s,\u201d he assumed.<\/span><\/p>\n<\/blockquote>\n<p><span data-preserver-spaces=\"true\">Some <\/span><span data-preserver-spaces=\"true\">of the<\/span><span data-preserver-spaces=\"true\"> well-known names that have already displayed intentions to launch an XRP ETF in America are <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/cryptopotato.com\/grayscale-files-for-ripple-xrp-etf-listing-on-nyse\/\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\"><span data-preserver-spaces=\"true\">Grayscale<\/span><\/a><span data-preserver-spaces=\"true\">, WisdomTree, Bitwise, 21Shares, and more. James Seyffart \u2013 an ETF research analyst at Bloomberg \u2013 recently <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/x.com\/JSeyff\/status\/1889037279194206208\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"external\"><span data-preserver-spaces=\"true\">set<\/span><\/a><span data-preserver-spaces=\"true\"> the odds of approval of such a product before the end of 2025 at 65%. <\/span><span data-preserver-spaces=\"true\">Moreover, he suggested that the SEC <\/span><span data-preserver-spaces=\"true\">might<\/span><span data-preserver-spaces=\"true\"> acknowledge some of the XRP ETF filings <\/span><span data-preserver-spaces=\"true\">as soon as<\/span><span data-preserver-spaces=\"true\"> this week.<\/span><span data-preserver-spaces=\"true\">\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Hogan <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/x.com\/attorneyjeremy1\/status\/1889025976723464695\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"external\"><span data-preserver-spaces=\"true\">agreed<\/span><\/a><span data-preserver-spaces=\"true\"> that the regulatory approval \u201ccan happen fast\u201d but reminded that the entire process is <\/span><span data-preserver-spaces=\"true\">quite<\/span><span data-preserver-spaces=\"true\"> complex and could <\/span><span data-preserver-spaces=\"true\">be fulfilled<\/span><span data-preserver-spaces=\"true\"> in 8-12 months.\u00a0<\/span><\/p>\n<h2><span data-preserver-spaces=\"true\">Ceasefire Incoming?<\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">Earlier this week, Binance and the US SEC jointly requested the magistrates to pause their lawsuit for 60 days. Eleanor Terrett, a journalist at Fox Business, <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/x.com\/EleanorTerrett\/status\/1889175581423796304\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"external\"><span data-preserver-spaces=\"true\">explained<\/span><\/a><span data-preserver-spaces=\"true\"> that both parties will use the time to issue a mutual status report to determine whether a continuation of the stay is warranted.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The development caused the XRP Army to raise their hopes that the agency and Ripple might <\/span><span data-preserver-spaces=\"true\">temporarily bury the hatches as well<\/span><span data-preserver-spaces=\"true\">.<\/span><span data-preserver-spaces=\"true\">\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">After all, the new Chairman of the securities regulator, Mark Uyeda, has previously revealed his support for the cryptocurrency industry. His stance is much different from that of his predecessor,<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/cryptopotato.com\/gary-gensler-officially-out-what-does-it-mean-for-ripple-xrp\/\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\"><span data-preserver-spaces=\"true\"> Gary Gensler<\/span><\/a><span data-preserver-spaces=\"true\">.
