{"id":14509,"date":"2025-02-22T16:03:19","date_gmt":"2025-02-22T16:03:19","guid":{"rendered":"https:\/\/dogewisperer.com\/?p=14509"},"modified":"2025-02-22T16:03:19","modified_gmt":"2025-02-22T16:03:19","slug":"crypto-victory-sec-agrees-to-drop-enforcement-case-against-coinbase-details","status":"publish","type":"post","link":"https:\/\/dogewisperer.com\/?p=14509","title":{"rendered":"Crypto Victory: SEC Agrees To Drop Enforcement Case Against Coinbase \u2013 Details"},"content":{"rendered":"<div>\n<p style=\"font-weight: 400;\">In a positive development for the crypto industry, the US Securities and Exchange Commission (SEC) plans to end its 20-month-long legal battle against crypto exchange platform Coinbase and withdraw the enforcement case, a shift from the agency\u2019s previous \u201cregulation by enforcement\u201d approach.<\/p>\n<h2 style=\"font-weight: 400;\">SEC To Dismiss Coinbase Lawsuit<\/h2>\n<p style=\"font-weight: 400;\">On Friday, Coinbase <a href=\"https:\/\/x.com\/coinbase\/status\/1892923603814936896\" target=\"_blank\" rel=\"noopener nofollow\">announced<\/a> that the SEC\u2019s staff had agreed in principle to drop its lawsuit against the crypto exchange platform. In a video shared on X, the exchange\u2019s CEO, Brian Armstrong, revealed that the US regulator had informed them of their plan to withdraw their litigation against the crypto platform.<\/p>\n<p style=\"font-weight: 400;\">He explained that the plan still needs approval from the SEC\u2019s Commissioners, which they hope will happen next week. The US regulator argued that Coinbase operated as an unregistered broker-dealer and was illegally selling unregistered securities through its staking program.<\/p>\n<p style=\"font-weight: 400;\">Following the SEC and Binance\u2019s joint <a href=\"https:\/\/bitcoinist.com\/us-sec-and-binance-request-60-day-pause-in-crypto-lawsuit-heres-why\/\" target=\"_blank\" rel=\"noopener \">motion<\/a> to stay their legal battle for 60 days, the industry speculated that other crypto litigations would follow suit. However, Coinbase was in a \u201cunique situation,\u201d journalist Eleanor Terret noted, as the lawsuit was halted in January after Judge Katherine Failla granted a \u201crare\u201d interlocutory appeal to the exchange.<\/p>\n<p style=\"font-weight: 400;\">A month ago, Coinbase filed a petition for permission to appeal, which the SEC had until February 14 to respond to. According to Terret, the agency\u2019s <a href=\"https:\/\/bitcoinist.com\/sec-vs-coinbase-us-regulators-next-move-to-reveal-a-lot-about-new-crypto-approach\/\" target=\"_blank\" rel=\"noopener \">response<\/a> would shed some light on how the US agency will approach crypto litigations under the new acting chair and new regulatory approach.<\/p>\n<p style=\"font-weight: 400;\">Last Friday, the SEC requested an additional 28 days to review the exchange\u2019s petition to appeal and suggested that the recently formed Crypto Task Force would potentially end the extended legal battle.<\/p>\n<h2 style=\"font-weight: 400;\">Crypto Legislation Remains A Key Priority<\/h2>\n<p style=\"font-weight: 400;\">In a blog post, Coinbase\u2019s CLO, Paul Grewal, <a href=\"https:\/\/www.coinbase.com\/blog\/righting-a-major-wrong\" target=\"_blank\" rel=\"noopener nofollow\">called<\/a> this development a victory \u201cnot just for Coinbase, but for our customers, the United States, and individual freedom.\u201d He noted that the SEC is now being held accountable for the enforcement cases driven by a change of political leadership.<\/p>\n<blockquote>\n<p style=\"font-weight: 400;\">Coinbase went public in April 2021. As part of that process, the SEC reviewed our business model and S1 disclosures and allowed us to go public. Two years later, they sued us. That\u2019s despite absolutely nothing changing in our business model. What changed over those two years was the political leadership at the SEC.
