According to Murphy, rather than the delay being solely due to the SEC\u2019s internal processes, it could be that Ripple is engaged in strenuous negotiations aimed at revising key components of Judge Torres\u2019 ruling.<\/p>\n<h2>Ripple, Not SEC, Might Be Stalling Case Resolution<\/h2>\n<p>Murphy <a href=\"https:\/\/x.com\/MetaLawMan\/status\/1895899204134060538\" target=\"_blank\" rel=\"noopener nofollow\">explained<\/a> that while Judge Torres\u2019 decision was undoubtedly beneficial for XRP holders\u2014particularly regarding aspects that positively impact market sentiment\u2014the decision also contained elements that could jeopardize the company\u2019s future strategic moves. \u201cThe <a href=\"https:\/\/bitcoinist.com\/ripple-ruling-judge-torres-could-be-thrown-out\/\" target=\"_blank\" rel=\"noopener \">Torres decision<\/a> was unquestionably GREAT for XRP holders, BUT the finding of securities law violations and the injunction with attendant \u2018bad boy\u2019 provisions are not so great for Ripple,\u201d Murphy stated via X.<\/p>\n<p>He further speculated that if Ripple is considering a future exempt securities offering or <a href=\"https:\/\/bitcoinist.com\/ripple-ipo-at-risk-of-being-delayed-expert-warns\/\" target=\"_blank\" rel=\"noopener \">an IPO<\/a>, the current judgment would represent a significant operational and reputational hurdle. He continued, \u201cI believe the SEC would have accepted a settlement\u2014where both sides dismiss their appeals and the SEC takes <a href=\"https:\/\/bitcoinist.com\/ripple-concludes-sec-battle-with-125m-penalty\/\" target=\"_blank\" rel=\"noopener \">the $125 million penalty<\/a>\u2014in a heartbeat. So, it makes sense that Ripple could be negotiating for a better deal than that.\u201d Although he acknowledges the speculative nature of his theory, Murphy\u2019s comments offer a glimpse into the complex legal maneuvers potentially at play.<\/p>\n<p>Complementing Murphy\u2019s perspective, pro-XRP lawyer Jeremy Hogan <a href=\"https:\/\/x.com\/attorneyjeremy1\/status\/1896232600580063304\" target=\"_blank\" rel=\"noopener nofollow\">delved<\/a> into the intricate legal process of dissolving the injunction imposed by Judge Torres. Hogan pointed out that the court\u2019s order effectively bars Ripple from making direct sales to customers\u2014a restriction that Ripple would undoubtedly prefer to eliminate.<\/p>\n<p>\u201cRipple would rather not have the injunction at all,\u201d Hogan remarked. He drew an analogy between the legal process and personal restraining orders, emphasizing that \u201conce a court issues an injunction, the parties themselves can\u2019t simply agree between them to disregard the injunction.\u201d He further illustrated the point with a vivid comparison: many individuals have faced legal consequences for assuming that a restraining order could be casually ignored when personal relationships improved.<\/p>\n<p>Hogan\u2019s analysis extended into the procedural challenges that both Ripple and the SEC must navigate in order to modify the existing court order. He elaborated on the role of Federal Rule 60, which governs \u201crelief from a judgment,\u201d noting that any motion to vacate the injunction must convincingly demonstrate a significant change in circumstances.<\/p>\n<p>\u201cThe court based its decision on the Howey test, not on the SEC\u2019s rule changes, and the SEC cannot \u2018Trump\u2019 US Supreme Court law,\u201d Hogan explained. This point underscores the rigidity of legal precedent in securities law, which complicates any attempt by Ripple to negotiate a rollback of the injunction solely on the basis of evolving regulatory standards.<\/p>\n<p>Ripple would first need to convince the SEC to sign off on a carefully drafted motion that seeks to dissolve the injunction. Following this, both parties would have to stipulate to dismiss their appeals, and then the trial court would need to rule favorably on the motion.
