Republican Commissioner Hester Peirce has shared some new insight on the US agency\u2019s regulatory shift and the upcoming framework.<\/p>\n<h2 style=\"font-weight: 400;\">Crypto Regulations Aren\u2019t A \u2018Game Of Gotcha\u2019<\/h2>\n<p style=\"font-weight: 400;\">In an <a href=\"https:\/\/fortune.com\/crypto\/2025\/03\/05\/sec-gensler-hester-peirce-crypto-regulation-coinbase-lawsuit\/\" target=\"_blank\" rel=\"noopener nofollow\">interview<\/a> with Fortune, SEC Commissioner Hester Peirce discussed the regulatory agency\u2019s new industry-friendly approach, led by the newly created Crypto Task Force, to develop a clear framework for digital assets.<\/p>\n<p style=\"font-weight: 400;\">Regarding the SEC\u2019s decision to drop most of its ongoing crypto litigations, the Republican Commissioner affirmed that the regulatory agency is \u201cpivoting in terms of how we think about whether to use our enforcement tools and when to use it.\u201d<\/p>\n<p style=\"font-weight: 400;\">The SEC\u2019s recent shift has seen the Commission dismiss or pause several litigations against key crypto companies, including Binance, Coinbase, and Kraken, and close many years-long investigations, like Gemini, <a href=\"https:\/\/bitcoinist.com\/us-sec-closes-robinhood-crypto-investigation-with-no-enforcement-action\/\" target=\"_blank\" rel=\"noopener \">Robinhood<\/a>, and Yuga Labs, without taking any enforcement actions.<\/p>\n<p style=\"font-weight: 400;\">According to the report, Commissioner Peirce considered most of those litigations \u201cpremature\u201d but added that bad actors shouldn\u2019t assume companies with a crypto label will get a \u201cfree pass,\u201d as the SEC will \u201ccontinue to go after \u2018run of the mill\u2019 securities violations.\u201d<\/p>\n<p style=\"font-weight: 400;\">Moreover, she argued that the <a href=\"https:\/\/bitcoinist.com\/coinbase-urges-us-congress-to-act-on-crypto-regulations-outlines-6-key-priorities\/\" target=\"_blank\" rel=\"noopener \">law<\/a> is \u201cnot supposed to be a game of gotcha\u201d and \u201cit doesn\u2019t make sense to bring in a lot of courts to look at this issue\u2014a process that takes a long time\u2014when we haven\u2019t sorted it out on our side yet.\u201d<\/p>\n<h2 style=\"font-weight: 400;\">SEC\u2019s Plan To Be Partially Implemented This Year<\/h2>\n<p style=\"font-weight: 400;\">The SEC\u2019s latest move follows the Trump administration\u2019s efforts to stop the \u201caggressive enforcement actions,\u201d eliminate \u201cregulatory overreach\u201d on digital assets, and promote the crypto industry\u2019s growth.<\/p>\n<p style=\"font-weight: 400;\">Peirce reportedly opposes having a \u201cMama government\u201d to protect investors from \u201cmaking bad choices.\u201d She pointed out that people lose money on many things, which would make the SEC\u2019s jurisdiction significantly bigger under that standard.<\/p>\n<blockquote>\n<p style=\"font-weight: 400;\">\u00a0If the standard of the SEC\u2019s jurisdiction turns on whether you can lose money on buying something, our jurisdiction is massive. But that isn\u2019t the jurisdiction that Congress gave us.<\/p>\n<\/blockquote>\n<p style=\"font-weight: 400;\">The crypto-friendly Commissioner has previously <a href=\"https:\/\/bitcoinist.com\/secs-peirce-case-review-crypto-enforcement-actions\/\" target=\"_blank\" rel=\"noopener \">stated<\/a> that the regulatory agency is working to \u201cget back to a path where we\u2019re really using our other tools to make policy\u201d instead of using enforcement cases as \u201ca way to make regulatory policy.\u201d<\/p>\n<p style=\"font-weight: 400;\">\u201cSome people have really bad scars from past interactions with the SEC,\u201d the Commissioner explained, noting that it was time to step back and revisit things. Peirce suggested that the regulatory agency can get people\u2019s input now that the crypto industry knows they can talk to the SEC\u2019s staff.<\/p>\n<p style=\"font-weight: 400;\">According to the report, she affirmed that the SEC would move forward with <a href=\"https:\/\/bitcoinist.com\/sec-and-cftc-crypto-collaboration-regulators-discussing-revival-of-joint-advisory-committee\/\" target=\"_blank\" rel=\"noopener \">establishing<\/a> its crypto regulatory framework despite waiting for Congress\u2019 confirmation of Trump-appointed SEC chairman Paul Atkins and market structure regulations.<\/p>\n<p style=\"font-weight: 400;\">Peirce also stated that \u201cpieces\u201d of the agency\u2019s plan would be established this year, including clarification of the security status of digital assets.
