{"id":17614,"date":"2025-03-13T15:02:22","date_gmt":"2025-03-13T15:02:22","guid":{"rendered":"https:\/\/dogewisperer.com\/?p=17614"},"modified":"2025-03-13T15:02:22","modified_gmt":"2025-03-13T15:02:22","slug":"xrp-lawsuit-lawyer-unveils-shockingly-simple-way-to-end-it","status":"publish","type":"post","link":"https:\/\/dogewisperer.com\/?p=17614","title":{"rendered":"XRP Lawsuit: Lawyer Unveils Shockingly Simple Way To End It"},"content":{"rendered":"<div>\n<p>In a possible turning point for the XRP lawsuit, Fox Business journalist Eleanor Terrett reported on Wednesday that the US Securities and Exchange Commission (SEC) and Ripple might soon reach an agreement. \u201cTwo well-placed sources tell me that the SEC vs. Ripple case [\u2026] could be over soon,\u201d Terrett <a href=\"https:\/\/bitcoinist.com\/sec-vs-ripple-legal-battle-approaching-end\/\" target=\"_blank\" rel=\"noopener \">revealed<\/a>, adding that \u201cthe delay in reaching an agreement is due to Ripple\u2019s legal team negotiating more favorable terms regarding the August district court ruling.\u201d<\/p>\n<p>That ruling hit Ripple with a $125 million fine and prohibited it from selling XRP to institutional investors. Terrett\u2019s sources suggest Ripple\u2019s team is pushing back, insisting that if the SEC\u2019s new leadership aims to \u201cwipe the enforcement slate clean\u201d for previously-targeted crypto firms, Ripple should not be held to a judgment that may no longer reflect the agency\u2019s stance. Terrett noted \u201cthere\u2019s no real playbook for this,\u201d emphasizing how this unique scenario may be \u201ctaking longer to resolve than the rest.\u201d<\/p>\n<h2>An Easy Path To End The XRP Lawsuit<\/h2>\n<p>Pro-XRP attorney Fred Rispoli <a href=\"https:\/\/x.com\/freddyriz\/status\/1899910511766233121\" target=\"_blank\" rel=\"noopener nofollow\">contends<\/a> via X that resolving the dispute over the ruling should be relatively straightforward\u2014if the SEC is willing. \u201cI just don\u2019t see this being the big issue some are making it out to be,\u201d he remarked, calling the process unorthodox but not overly complicated.<\/p>\n<p>According to Rispoli, there are multiple ways the agency and Ripple could neutralize <a href=\"https:\/\/bitcoinist.com\/ripple-negotiating-hard-causing-sec-delay\/\" target=\"_blank\" rel=\"noopener \">Judge Torres\u2019 order<\/a>. He stressed: \u201cThe SEC and Ripple can file a motion to vacate the judgment\u2013the cleanest way to dispose of it. Telling the the Court \u2018in consideration for potentially losing our entire crypto jurisdiction if we lose the appeal, we\u2019re agreeing to vacate judgment in exchange for Ripple dropping its appeal.\u2019 Torres is not going to second guess this.\u201d<\/p>\n<p>He also noted that even without formally vacating the order, the SEC could draft an agreement stating it will not enforce the ruling for the same consideration. \u201cThe SEC doesn\u2019t even have to vacate the order. It can simply draft an agreement with Ripple that it won\u2019t enforce the judgment for the same consideration set out,\u201d Rispoli said.<\/p>\n<p>Alluding to the agency\u2019s broad discretion under its Enforcement Manual, which routinely recommends settlement over uncertain litigation, Rispoli added: \u201cThe SEC Enforcement Manual has all kinds of general, vague language that recommends cooperation and settlement over the uncertainties of litigation so the authority for this behavior is covered [\u2026] but even if it weren\u2019t, who cares? This isn\u2019t a good thing, but the SEC (and most other .gov agencies) has proven it does what it wants, when it wants, without regard to due process. Here, it works in justice\u2019s favor for once.\u201d<\/p>\n<p>Despite Rispoli\u2019s optimism, some community members worry about a potential resurgence of stricter enforcement under different leadership down the line. One user on social media platform X posed the question: \u201cWhat if, say, in 4 years, we are back to a Gensler-style SEC and the SEC then tries to enforce the injunction?\u201d<\/p>\n<p>Rispoli responded: \u201cThat\u2019s the ONLY fear \u2026 But it could be wiped out with a superseding agreement between SEC and Ripple. And if your scenario happens, crypto already lost and a lot more folks than just Ripple would be worried.\u201d<\/p>\n<h2>Can A Court\u2019s Decision Really Be Overridden?<\/h2>\n<p>A second point of contention involves whether or not the SEC can effectively negate a district court\u2019s decision through a <a href=\"https:\/\/bitcoinist.com\/ripple-sec-settlement-forward\/\" target=\"_blank\" rel=\"noopener \">negotiated settlement<\/a>. Critics argue that administrative agencies should not be able to override final rulings.<\/p>\n<p>Rispoli, however, referenced a notable precedent involving Citigroup. He pointed to SEC v. Citigroup Global Markets, Inc., 673 F.3d 158 (2d Cir. 2012), in which an appellate court reversed a district judge\u2019s refusal to approve an SEC settlement.<\/p>\n<p>\u201cIt\u2019s happened before,\u201d he noted, highlighting that courts often give significant deference to consent decrees and settlement agreements proposed by the SEC and its enforcement targets.
