{"id":18025,"date":"2025-03-19T09:46:37","date_gmt":"2025-03-19T09:46:37","guid":{"rendered":"https:\/\/dogewisperer.com\/?p=18025"},"modified":"2025-03-19T09:46:37","modified_gmt":"2025-03-19T09:46:37","slug":"us-sec-to-review-proposed-crypto-custody-rule-amid-new-rulemaking-approach","status":"publish","type":"post","link":"https:\/\/dogewisperer.com\/?p=18025","title":{"rendered":"US SEC To Review Proposed Crypto Custody Rule Amid New Rulemaking Approach"},"content":{"rendered":"<div>\n<p style=\"font-weight: 400;\">The US Securities and Exchange Commission (SEC) acting chair revealed that the agency is reviewing its rulemaking process and will revisit a controversial rule on crypto custody requirements for investment advisers proposed during the Biden administration.<\/p>\n<h2 style=\"font-weight: 400;\">Crypto Custody Rule Proposal Could Be Abandoned<\/h2>\n<p style=\"font-weight: 400;\">At the Investment Company Institute\u2019s 2025 Investment Management Conference, SEC\u2019s acting chair, Mark Uyeda, <a href=\"https:\/\/www.sec.gov\/newsroom\/speeches-statements\/uyeda-ici-031725\" target=\"_blank\" rel=\"noopener nofollow\">discussed<\/a> the regulatory agency\u2019s new approach to rulemaking. During the Monday conference, he affirmed that the Commission\u2019s blueprint must prioritize \u201ceffective and cost-efficient regulations that respect the limits of our statutory authority.\u201d<\/p>\n<p style=\"font-weight: 400;\">As a result, the SEC could work on a \u201cback to basics\u201d framework for its rulemaking process. Under this framework, the agency could consider withdrawing or re-proposing existing rule proposals, as some, including the 2023 crypto custody rule, raise various concerns.<\/p>\n<p style=\"font-weight: 400;\">On February 2023, the Commission, led by Gary Gensler, voted to pass a proposal to make amendments to the 2009 Custody Rule, which would \u201cexpand and enhance the role of qualified custodians when registered investment advisers custody assets on behalf of investors,\u201d <a href=\"https:\/\/x.com\/GenslerArchive\/status\/1625899563167916032\" target=\"_blank\" rel=\"noopener nofollow\">stated<\/a> the former SEC chair.<\/p>\n<p style=\"font-weight: 400;\">Under the 2009 rule, registered investment advisers must hold their client assets with a qualified custodian, like a bank or broker-dealer. The proposed amendment would expand the custody rule to include virtually any asset, including crypto, which raised several concerns among industry players.<\/p>\n<p style=\"font-weight: 400;\">At the time, Uyeda <a href=\"https:\/\/www.sec.gov\/newsroom\/speeches-statements\/uyeda-statement-custody-021523\" target=\"_blank\" rel=\"noopener nofollow\">stated<\/a>, \u201cThis approach to custody appears to mask a policy decision to block access to crypto as an asset class. It deviates from the Commission\u2019s long-standing position of neutrality on the merits of investments.\u201d<\/p>\n<p style=\"font-weight: 400;\">On Monday, The SEC\u2019s acting chair <a href=\"https:\/\/bitcoinist.com\/sec-uyeda-challenges-rule-on-crypto-trading-venues\/\" target=\"_blank\" rel=\"noopener \">revealed<\/a> that \u201cthere may be significant challenges to proceeding with the original proposal.\u201d Based on this, he asked the regulatory agency\u2019s staff to \u201cwork closely with the Crypto Task Force to consider the appropriate alternatives, including its withdrawal.\u201d<\/p>\n<p style=\"font-weight: 400;\">He also affirmed that the Commission could consider extending or delaying compliance dates for some recently adopted rules.<\/p>\n<h2 style=\"font-weight: 400;\">US SEC Returning To A \u2018Smoother\u2019 Regulatory Approach<\/h2>\n<p style=\"font-weight: 400;\">Uyeda criticized the past administration\u2019s approach to rulemaking and regulatory changes, asserting that these \u201cwere not for the better.\u201d Moreover, he added that the \u201crulemaking shortcuts\u201d have \u201creturned to haunt the Commission in subsequent litigation.\u201d<\/p>\n<blockquote>\n<p style=\"font-weight: 400;\">Turning to future rulemaking, the Commission should act like a super-sized freighter, not a speed boat \u2013 and that means returning to a smoother regulatory course than the rapid changes that have been promulgated over the last four years. Investors and the industry must be able to rely on us to act consistent with precedent and through an informed and thorough public process.<\/p>\n<\/blockquote>\n<p style=\"font-weight: 400;\">Uyeda concluded that the Commission needs to \u201ctake the time to do things carefully and methodically, rather than rush and risk\u00a0actions that are not fully thought through.\u201d<\/p>\n<p style=\"font-weight: 400;\">The acting chair\u2019s remarks follow the ongoing changes in the SEC\u2019s approach to the crypto industry under the Trump administration.
