In a significant development for the cryptocurrency industry, Ripple Labs CEO Brad Garlinghouse announced that the US Securities and Exchange Commission (SEC) has officially dropped its case against the blockchain payments company.\u00a0<\/p>\n

SEC Drops Case Against Ripple<\/h2>\n

In a four-minute video<\/a> shared on social media, Garlinghouse declared, \u201cI\u2019m finally able to announce, this case has ended, it\u2019s over.\u201d He emphasized that the SEC\u2019s case, initiated under the leadership of former Chair Gary Gensler, was destined for failure from the start. Garlinghouse characterized this moment as a significant victory, describing it as a \u201clong overdue surrender\u201d by the SEC.<\/p>\n

Garlinghouse further criticized Gensler, who resigned on January 20, the same day President Donald Trump took office, for his aggressive stance against the cryptocurrency sector.\u00a0<\/p>\n

Ripple\u2019s CEO claimed that the SEC under Gensler sought to intimidate the entire industry, using arguments similar to those employed in the Ripple case.<\/p>\n

The SEC had alleged that Ripple and its executives raised over $1.3 billion through an unregistered ongoing securities offering involving the sale of XRP. According to the lawsuit filed four years ago, Ripple had been selling XRP since 2013 without registering the asset as a security, thereby violating federal securities laws.<\/p>\n

With the case now resolved, Garlinghouse asserted that XRP is no longer viewed as a security under the Howey Test, a critical legal standard used to determine whether certain transactions qualify as investment contracts.\u00a0<\/p>\n

This clarity is not only essential for regulatory compliance but also supports the approval of XRP exchange-traded funds (ETFs) that have been filed by major asset managers seeking regulatory green lights this year.<\/p>\n

This victory comes as the SEC, now under the acting chair Mark Uyeda, appears to have shifted its stance, aligning more with the current administration\u2019s focus on fostering innovation in the digital asset space.\u00a0<\/p>\n

In response to the news, XRP\u2019s price surged nearly 12%, climbing back above the $2.4 mark after experiencing a dip to $1.7 during February\u2019s market sell-off.\u00a0<\/p>\n
