The company\u2019s CEO, Brad Garlinghouse,\u00a0<a href=\"https:\/\/cryptopotato.com\/breaking-ripple-news-sec-will-drop-appeal-xrp-price-reacts\/\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\">announced<\/a> the breaking news,<\/span>\u00a0stating that the agency has dropped its appeal, which means the case \u201chas ended and it\u2019s over.\u201d\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The disclosure triggered <\/span><span data-preserver-spaces=\"true\">huge<\/span><span data-preserver-spaces=\"true\"> excitement across the XRP army, and many X users started celebrating the victory. <\/span><span data-preserver-spaces=\"true\">However, some legal experts noted that the lawsuit has technically not yet been concluded<\/span><span data-preserver-spaces=\"true\">.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The US lawyer Jeremy Hogan (who has been following the case\u2019s development over the past few years) <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/x.com\/attorneyjeremy1\/status\/1902353009029607586\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"external\"><span data-preserver-spaces=\"true\">suggested<\/span><\/a><span data-preserver-spaces=\"true\"> the \u201cbad stuff\u201d is over, but Ripple can now prolong the battle <\/span><span data-preserver-spaces=\"true\">in different ways<\/span><span data-preserver-spaces=\"true\">.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">He pointed out the $125 million fine that Judge Torres <a href=\"https:\/\/cryptopotato.com\/ripple-fined-125m-in-lawsuit-against-sec-xrp-price-soars-20-immediately\/\" data-wpel-link=\"internal\">ordered<\/a> on the company last year for violating <\/span><span data-preserver-spaces=\"true\">certain<\/span><span data-preserver-spaces=\"true\"> securities laws. According to Hogan, there are four possible scenarios from here on.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">First, he thinks Ripple can continue its appeal to the penalty and \u201cget a ruling from an appellate court on whether investment contracts require contracts.\u201d Second, the firm might agree to drop its appeal, and <\/span><span data-preserver-spaces=\"true\">then<\/span><span data-preserver-spaces=\"true\"> both parties could try to amend the judgment.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The third option includes the two sides entering a mutual agreement without attempting to change Judge Torres\u2019 ruling. <\/span><span data-preserver-spaces=\"true\">Lastly,<\/span><span data-preserver-spaces=\"true\"> Hogan believes Ripple might decide to pay the multi-million fine \u201cand move on.\u201d<\/span><\/p>\n<h2><span data-preserver-spaces=\"true\">The Appeal Seems Like an \u2018Unnecessary Gamble\u2019<\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">Another popular attorney who touched upon the matter was Fred Rispoli. He <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/x.com\/freddyriz\/status\/1902390368244789648\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"external\"><span data-preserver-spaces=\"true\">described<\/span><\/a><span data-preserver-spaces=\"true\"> Ripple\u2019s potential appeal as an \u201cunnecessary gamble\u201d for three important reasons.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">First, the US Court of Appeals for the Second Circuit can rule against the company, which could cause <\/span><span data-preserver-spaces=\"true\">serious<\/span><span data-preserver-spaces=\"true\"> reputational damage. He also believes that federal legislation \u201ccan essentially erase the loss.\u201d<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Last but not least, Rispoli claimed that Ripple has already claimed that its operations did not engage in any <\/span><span data-preserver-spaces=\"true\">of the activities that were previously deemed illegal<\/span><span data-preserver-spaces=\"true\">.<\/span><span data-preserver-spaces=\"true\">\u00a0<\/span><\/p>\n<blockquote>\n<p><span data-preserver-spaces=\"true\">\u201c<\/span><span data-preserver-spaces=\"true\">But:<\/span><span data-preserver-spaces=\"true\"> Maintaining it for now IS the legal \u201cconsideration\u201d that would sufficiently justify reducing<\/span><span data-preserver-spaces=\"true\"> $<\/span><span data-preserver-spaces=\"true\">125M penalty in <\/span><span data-preserver-spaces=\"true\">exchanging<\/span><span data-preserver-spaces=\"true\"> for dropping <\/span><span data-preserver-spaces=\"true\">appeal<\/span><span data-preserver-spaces=\"true\">,\u201d he added.<\/span><\/p>\n<\/blockquote>\n<p>The post <a href=\"https:\/\/cryptopotato.com\/ripple-v-sec-is-the-lawsuit-really-over-or-is-there-more-to-the-story\/\" rel=\"nofollow\">Ripple v.
