Judge Rejects Former Celsius CEO\u2019s Attempt To Dismiss Fraud Charges"},"content":{"rendered":"<div>\n<p>A former executive of a now-defunct cryptocurrency firm, Celsius Network, will have to continue to face his legal battle as a US federal court denied his motion to dismiss the charges against him.<\/p>\n<p>It might seem only like a legal battle of a former crypto CEO but in the greater scheme of things, it\u2019s a reflection of the saga of the government\u2019s scrutiny on the digital currency industry.<\/p>\n<h2>Motion Denied<\/h2>\n<p>The ex-CEO of Celsius Network, <a href=\"https:\/\/news.bloomberglaw.com\/us-law-week\/celsius-crypto-founder-loses-bid-to-toss-some-fraud-charges\" target=\"_blank\" rel=\"noopener nofollow\">Alex Mashinsky<\/a>, failed to convince a US federal judge to drop two counts of criminal charges against him relating to the manipulation of crypto prices and fraud.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Judge Rejects Ex-Celsius CEO\u2019s Attempt to Drop Fraud Charges<\/p>\n<p>The latest twist in the Celsius saga: Alex Mashinsky, former CEO of Celsius, just had his motion to dismiss key charges thrown out by a federal judge.<\/p>\n<p>Mashinsky, who faces seven charges, tried to argue that two of\u2026 <a href=\"https:\/\/t.co\/oEa3SkFdHe\" rel=\"nofollow noopener\" target=\"_blank\">pic.twitter.com\/oEa3SkFdHe<\/a><\/p>\n<p>\u2014 IBC Group Official (@ibcgroupio) <a href=\"https:\/\/twitter.com\/ibcgroupio\/status\/1856110314065895532?ref_src=twsrc%5Etfw\" rel=\"nofollow noopener\" target=\"_blank\">November 11, 2024<\/a><\/p>\n<\/blockquote>\n<p>Judge John Koeltl of the US District Court for the Southern District of New York <a href=\"https:\/\/tradersunion.com\/news\/cryptocurrency-news\/show\/15434-judge-denies-ex-celsius\/\" target=\"_blank\" rel=\"noopener nofollow\">rejected Mashinsky\u2019s motion<\/a> asking the court to dismiss the two raps against him. Thus, Mashinsky will continue to face the seven complaints in relation to his role in Celsius in January 2025 \u2014 a setback that made it inevitable for Mashinsky to defend himself in court when the trial started.<\/p>\n<p>Koeltl ruled that the crypto exec\u2019s arguments to drop the cases were \u201ceither moot or without merit.\u201d<\/p>\n<h2>Mashinsky\u2019s Argument<\/h2>\n<p>Mashinsky\u2019s lawyers argued that their client cannot be charged with violations of the Commodity Exchange Act and the Securities Exchange Act of 1934, saying the court is charging the former CEO with two charges for the same conduct.<\/p>\n<p><img data-recalc-dims=\"1\" fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter wp-image-339306 size-large\" src=\"https:\/\/bitcoinist.com\/wp-content\/uploads\/2024\/11\/A_3af11a.png?resize=858%2C660\" alt=\"\" width=\"858\" height=\"660\" srcset=\"https:\/\/bitcoinist.com\/wp-content\/uploads\/2024\/11\/A_3af11a.png?w=957 957w, https:\/\/bitcoinist.com\/wp-content\/uploads\/2024\/11\/A_3af11a.png?w=546 546w, https:\/\/bitcoinist.com\/wp-content\/uploads\/2024\/11\/A_3af11a.png?w=768 768w, https:\/\/bitcoinist.com\/wp-content\/uploads\/2024\/11\/A_3af11a.png?w=858 858w, https:\/\/bitcoinist.com\/wp-content\/uploads\/2024\/11\/A_3af11a.png?w=750 750w\" sizes=\"(max-width: 858px) 100vw, 858px\"><\/p>\n<p>However, Koeltl disagreed with their argument, saying a conviction on violating the Securities Exchange Act would not mean that Mahinsky would be acquitted of violating the Commodity Exchange Act.<\/p>\n<p>Mahinsky also claimed that the commodities charge is \u201clegally insufficient\u201d, explaining that the state prosecutors failed to sufficiently allege that the platform\u2019s investors were depositing Bitcoin into a program that offered a weekly reward scheme. The federal judge argued that this argument is a factual question that \u201ccannot be resolved\u201d at this point in the case.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full\" src=\"https:\/\/www.tradingview.com\/x\/UEnwKAEj\/\" width=\"1835\" height=\"857\"><\/p>\n<p>Koeltl also denied Mashinsky\u2019s motion to dismiss market manipulation charges, saying it is \u201cmeritless\u201d. The judge added that the US Court of Appeals for the Second Circuit has already ruled before that \u201copen-market transactions that are not inherently manipulative may constitute manipulative activity when accompanied by manipulative intent.\u201d<\/p>\n<h2>Celsius: Legal Woes<\/h2>\n<p>Celsius used to be a prominent crypto platform in the industry. Unfortunately, the firm collapsed in 2022 following the freezing of customer withdrawals. The company also filed for bankruptcy amidst the huge balance sheet deficit.<\/p>\n<p>As a result, the SEC charged Mashinsky with fraud and manipulating the market which caused the collapse of the crypto firm.<\/p>\n<p>State authorities said that the crypto CEO deceived the investors and claimed that CEL, the firm\u2019s coin, was safer than it was.<\/p>\n<p>If convicted of all the seven charges, Mashinsky could spend 115 years in state prison.
