{"id":27822,"date":"2025-05-21T09:17:11","date_gmt":"2025-05-21T09:17:11","guid":{"rendered":"https:\/\/dogewisperer.com\/?p=27822"},"modified":"2025-05-21T09:17:11","modified_gmt":"2025-05-21T09:17:11","slug":"australian-securities-regulator-wants-to-appeal-high-courts-decision-on-block-earner","status":"publish","type":"post","link":"https:\/\/dogewisperer.com\/?p=27822","title":{"rendered":"Australian Securities Regulator Wants to Appeal High Court&#8217;s Decision on Block Earner"},"content":{"rendered":"<div>\n<p>The Australian Securities and Investments Commission (ASIC) is seeking leave to appeal a High Court decision that fintech company Block Earner&#8217;s Access product is not a financial product.<\/p>\n<p>The High Court in March 2024 <a href=\"https:\/\/www.coindesk.com\/policy\/2024\/02\/12\/australian-judge-hands-split-decision-in-markets-regulator-vs-block-earner\">dismissed ASIC&#8217;s allegations that Block Earner had engaged in unlicensed financial services<\/a> by offering its decentralized finance (DeFi) product Access.<\/p>\n<p>ASIC is seeking clarification on how a financial product is defined which it feels should apply to all products whether they involve cryptocurrency or not. <\/p>\n<p>&#8220;The High Court will consider ASIC\u2019s application on a date to be determined,&#8221; ASIC <a href=\"https:\/\/asic.gov.au\/about-asic\/news-centre\/find-a-media-release\/2025-releases\/25-082mr-asic-seeks-leave-from-high-court-to-appeal-block-earner-decision\/\">said in an announcement on Wednesday<\/a>.<\/p>\n<p>The Court gave a split decision over ASIC&#8217;s case against Block Earner last year, upholding the claim that it had engaged in unlicensed financial services with its Earner product while dismissing the allegations against Access.<\/p>\n<p>Block Earner, which has backing from crypto exchange Coinbase, was however freed from its $350,000 Earner-related fine by the Court in June, which ASIC also appealed.
