{"id":32976,"date":"2025-06-21T10:16:30","date_gmt":"2025-06-21T10:16:30","guid":{"rendered":"https:\/\/dogewisperer.com\/?p=32976"},"modified":"2025-06-21T10:16:30","modified_gmt":"2025-06-21T10:16:30","slug":"arizona-senate-revives-failed-bitcoin-reserve-bill-for-seized-crypto-assets","status":"publish","type":"post","link":"https:\/\/dogewisperer.com\/?p=32976","title":{"rendered":"Arizona Senate Revives Failed Bitcoin Reserve Bill For Seized Crypto Assets"},"content":{"rendered":"<div>\n<p style=\"font-weight: 400;\">Arizona, one of the first states to establish a Bitcoin (BTC) reserve, has revived a failed crypto legislation seeking to update the state\u2019s forfeiture law to include digital assets.<\/p>\n<h2 style=\"font-weight: 400;\">Arizona Lawmakers Reconsider Failed Bitcoin Reserve Bill<\/h2>\n<p style=\"font-weight: 400;\">The Arizona State Senate <a href=\"https:\/\/x.com\/Bitcoin_Laws\/status\/1935816400532390085\" target=\"_blank\" rel=\"noopener nofollow\">voted<\/a> to revive a Bitcoin reserve bill that failed to pass the House of Representatives\u2019 third reading last month. On Thursday, the Senate voted 16-14 in favor of the motion to reconsider the legislation, which is now headed back to the House.<\/p>\n<p style=\"font-weight: 400;\">The measure was filed by Republican Senator Janae Shamp, one of the Senate members who voted against the bill last month, as only a lawmaker who opposed the legislation can file this motion.<\/p>\n<p style=\"font-weight: 400;\">House Bill 2324 (HB 2324), introduced by Republican Representative Jeff Weninger, aims to update Arizona\u2019s forfeiture laws to include digital assets and establish new provisions for seizing, storing, and allocating cryptocurrencies and other digital assets.<\/p>\n<p style=\"font-weight: 400;\">The bill would establish new procedures for law enforcement to seize digital assets, including Bitcoin, gaining access to digital wallets and private keys. Additionally, it would <a href=\"https:\/\/bitcoinist.com\/connecticut-lawmakers-pass-bill-banning-state-investments-in-crypto\/\" target=\"_blank\" rel=\"noopener \">create<\/a> a \u201cBitcoin and Digital Assets Reserve Fund\u201d to manage seized assets.<\/p>\n<p style=\"font-weight: 400;\">The funds allocation would see the first $300,000 worth of seized assets go to the Attorney General\u2019s office. Meanwhile, any amount over that would be divided 50% to the Attorney General\u2019s office, 25% to the State General Fund, and 25% to the new Digital Assets Reserve Fund.<\/p>\n<p style=\"font-weight: 400;\">HB 2324 also clarifies rules around property forfeiture, including protections for innocent owners and limitations on when properties can be seized, aiming to modernize forfeiture laws to address the complexity of crypto in criminal investigations.<\/p>\n<h2 style=\"font-weight: 400;\">Crypto Legislation In Arizona<\/h2>\n<p style=\"font-weight: 400;\">The revival follows the enactment of a bill that updated Arizona\u2019s unclaimed property laws to include Bitcoin and other cryptocurrencies, technically creating the state\u2019s first crypto reserve.<\/p>\n<p style=\"font-weight: 400;\">House Bill 2749 (HB 2749), also sponsored by Representative Weninger, was <a href=\"https:\/\/bitcoinist.com\/one-vote-away-texas-advances-strategic-bitcoin-reserve-bill-to-full-house-vote\/\" target=\"_blank\" rel=\"noopener \">signed<\/a> into law by Arizona Governor Katie Hobbs on May 7, allowing authorities to keep unclaimed cryptocurrencies and other assets and establish a \u201cBitcoin Reserve Fund\u201d without using state funds or taxpayers\u2019 money.<\/p>\n<p style=\"font-weight: 400;\">The legislation doesn\u2019t <a href=\"https:\/\/www.azleg.gov\/press\/house\/57LEG\/1R\/250507WENINGERHB2749.pdf\" target=\"_blank\" rel=\"noopener nofollow\">allow<\/a> investments, but enables the state to move unclaimed assets, airdrops, and staking rewards into a reserve.<\/p>\n<blockquote>\n<p style=\"font-weight: 400;\">HB 2749 updates Arizona\u2019s unclaimed property laws to account for the growing presence of digital assets, including cryptocurrencies. The law establishes a clear process for identifying and handling unclaimed virtual property, protects the value of digital assets held by the state, and creates a reserve fund that may be used for future appropriations with legislative approval.<\/p>\n<\/blockquote>\n<p style=\"font-weight: 400;\">Policy tracking platform Bitcoin Laws noted that this was a significant move as it showed Governor Hobbs is \u201cwilling to enact pro-crypto legislation,\u201d despite vetoing two crypto bills last Month.<\/p>\n<p style=\"font-weight: 400;\">As <a href=\"https:\/\/bitcoinist.com\/arizona-state-governor-vetos-bitcoin-reserve-bill\/\" target=\"_blank\" rel=\"noopener \">reported<\/a> by Bitcoinist, Arizona\u2019s Governor vetoed Senate Bill 1025 (SB 1025) and Senate Bill 1373 (SB 1373), arguing that crypto assets were too \u201cuntested\u201d and volatile for state funds.<\/p>\n<p style=\"font-weight: 400;\">SB 1025, also known as the \u201cArizona Strategic Bitcoin Reserve Act,\u201d would have allowed public funds in Arizona, such as the state treasury or retirement system, to invest up to 10% of their assets under management (AuM) in cryptocurrencies.<\/p>\n<p style=\"font-weight: 400;\">Meanwhile, SB 1373 would have established a \u201cDigital Assets Strategic Reserve Fund\u201d that didn\u2019t include retirement fund investment.
