{"id":38668,"date":"2025-07-24T19:01:52","date_gmt":"2025-07-24T19:01:52","guid":{"rendered":"https:\/\/dogewisperer.com\/?p=38668"},"modified":"2025-07-24T19:01:52","modified_gmt":"2025-07-24T19:01:52","slug":"yuga-labs-bored-ape-yacht-club-9m-win-against-ryder-ripps-overturned-must-better-prove-trademark-infringement","status":"publish","type":"post","link":"https:\/\/dogewisperer.com\/?p=38668","title":{"rendered":"Yuga Labs Bored Ape Yacht Club $9M Win Against Ryder Ripps Overturned, Must Better Prove Trademark Infringement"},"content":{"rendered":"<div>\n<p>The creator of the Bored Ape Yacht Club non-fungible tokens (NFTs) needs to better prove that a &#8220;satirical&#8221; version of these tokens was meant to mislead would-be buyers, a U.S. appeals court said Wednesday, overturning a lower court ruling and sending the case back to that lower court for a new trial. <\/p>\n<p>The U.S. Court of Appeals for the Ninth Circuit ruled that a District Court finding that Ryder Ripps&#8217; NFT collection harmed Yuga Labs&#8217; trademarked NFTs needs to be reconsidered, though without weighing in on whether there was indeed trademark infringement \u2014 only that Yuga needed to do a better job of demonstrating that under the law at a new trial, <a href=\"https:\/\/cases.justia.com\/federal\/appellate-courts\/ca9\/24-879\/24-879-2025-07-23.pdf?ts=1753288237\">a court document said<\/a>.<\/p>\n<p>Ryder Ripps and Jeremy Cahen, the duo behind the RR\/BAYC NFT collection, had previously argued that their tokens were meant to be a satirical response to the actual BAYC. Yuga Labs sued in 2022, alleging trademark infringement and cybersquatting.<\/p>\n<p>A partial summary judgement by a district judge found <a href=\"https:\/\/www.coindesk.com\/web3\/2023\/04\/22\/judge-rules-bored-ape-yacht-club-ripoff-nfts-violated-yuga-copyright\">that Yuga does own trademarks<\/a> to its Bored Ape Yacht Club NFT collection and that Ripps&#8217; RR\/BAYC NFT collection did cause confusion as the images did look similar. Ripps appealed the <a href=\"https:\/\/www.theblock.co\/post\/275909\/ryder-ripps-must-pay-yuga-labs-9-million-after-lawsuits-final-judgment\">final ruling<\/a>, which included an over $8 million fine to be paid to Yuga.
