{"id":44279,"date":"2025-08-27T07:01:40","date_gmt":"2025-08-27T07:01:40","guid":{"rendered":"https:\/\/dogewisperer.com\/?p=44279"},"modified":"2025-08-27T07:01:40","modified_gmt":"2025-08-27T07:01:40","slug":"kraken-and-sec-crypto-task-force-discuss-asset-tokenization-amid-regulatory-concerns","status":"publish","type":"post","link":"https:\/\/dogewisperer.com\/?p=44279","title":{"rendered":"Kraken And SEC Crypto Task Force Discuss Asset Tokenization Amid Regulatory Concerns"},"content":{"rendered":"<div>\n<p style=\"font-weight: 400;\">The US Securities and Exchange Commission\u2019s staff and crypto exchange Kraken recently discussed various issues related to the tokenization of traditional assets and the regulatory framework for these assets.<\/p>\n<h2 style=\"font-weight: 400;\">Kraken Meets With Crypto Task Force<\/h2>\n<p style=\"font-weight: 400;\">On Monday, Kraken and the US SEC Crypto Task Force\u2019s staff met to <a href=\"https:\/\/www.sec.gov\/files\/ctf-memo-payward-inc-kraken-securities-llc-wilmer-cutler-pickering-hale-dorr-llp-082525.pdf\" target=\"_blank\" rel=\"noopener nofollow\">discuss<\/a> the tokenization of traditional assets and a potential tokenized trading system in the US. The Commission\u2019s staff had a meeting with representatives from Payward, Inc., Kraken Securities LLC, and law firm Wilmer Cutler Pickering Hale and Dorr LLP.<\/p>\n<p style=\"font-weight: 400;\">According to the SEC\u2019s memorandum, the agenda included approaches to address issues related to the regulation of crypto assets and the legal and regulatory framework for operating a tokenized trading system.<\/p>\n<p style=\"font-weight: 400;\">Notably, the topics also included an outline of the core components of the proposed tokenized trading system\u2019s architecture, addressing potentially relevant provisions under the federal securities laws, examining how the SEC can provide regulatory clarity and facilitate innovation, and discussing the benefits of tokenization.<\/p>\n<p style=\"font-weight: 400;\">The reunion follows the crypto exchange\u2019s interest in launching tokenized stocks of popular equities outside of the US. In May, Kraken <a href=\"https:\/\/bitcoinist.com\/kraken-to-offer-tokenized-stock-trading-for-non-us\/\" target=\"_blank\" rel=\"noopener \">announced<\/a> its plan to allow non-US customers to trade a tokenized version of popular equities, offering over 50 stocks and Exchange-Traded Funds (ETFs), like Apple, Tesla, and Nvidia.<\/p>\n<p style=\"font-weight: 400;\">Kraken\u2019s tokenized equities enable users in Europe, Latin America, Africa, and Asia to invest in US stocks even when the US stock market is closed, with lower trading costs and faster settlement.<\/p>\n<p style=\"font-weight: 400;\">Similarly, Coinbase is <a href=\"https:\/\/bitcoinist.com\/coinbase-seeks-us-approval-launch-tokenized-stocks\/\" target=\"_blank\" rel=\"noopener \">seeking<\/a> the SEC\u2019s approval to offer tokenized stocks to its customers. In June, Coinbase\u2019s Chief Legal Officer (CLO), Paul Grewal, told Reuters that the emerging sector is a \u201chuge priority\u201d for the crypto exchange.<\/p>\n<p style=\"font-weight: 400;\">Nonetheless, Coinbase would need to be granted a \u201cno action letter\u201d or exemptive relief from the Commission, as typically, companies that offer trading in securities must be registered as broker-dealers under the securities regulator.<\/p>\n<p style=\"font-weight: 400;\">\u201cWith a no-action letter, an issuer of a tokenized equity or a platform that wishes to offer secondary trading in those equities can have some confidence, some comfort, that the SEC has adopted its view of why this product is compliant,\u201d Grewal stated, noting that, \u201cit\u2019s that confidence that has been lacking so far, and I think really held back a lot of the institutional adoption\u201d of crypto and blockchain technology.<\/p>\n<h2 style=\"font-weight: 400;\">Industry Concerns For Tokenized Equities<\/h2>\n<p style=\"font-weight: 400;\">Kraken\u2019s push for regulatory clarity regarding tokenized stocks also follows recent concerns from the world\u2019s biggest stock exchanges. On August 25, Reuters <a href=\"https:\/\/bitcoinist.com\/stock-exchanges-crackdown-crypto-tokenized-stocks\/\" target=\"_blank\" rel=\"noopener \">reported<\/a> that the World Federation of Exchanges (WFE) called on securities regulators to crack down on tokenized equities, arguing that the blockchain-based tokens \u201ccreate new risks for investors and could harm market integrity.\u201d<\/p>\n<p style=\"font-weight: 400;\">The letter was reportedly sent to the SEC\u2019s Crypto Task Force, the European Securities and Markets Authority (ESMA), and global securities watchdog IOSCO\u2019s Fintech Task Force on August 22.
