The SEC crypto news shows the plans to introduce a formal \u201ctoken taxonomy\u201d that could redefine how digital assets are classified under US law.<\/span><\/p>\n

Speaking in Philadelphia on November 12, SEC Chair Paul S. Atkins <\/span>said<\/span><\/a> the agency will \u201cin the coming months\u201d propose a structured framework based on the Supreme Court\u2019s Howey test, the legal standard used to decide whether an asset counts as a security.\u00a0<\/span><\/p>\n

The move aims to bring clarity to one of the most contentious areas in crypto regulation: determining when a token constitutes a security and when it does not.<\/span><\/p>\n

Atkins also said the Commission intends to release a \u201cpackage\u201d of exemptions designed to create a more flexible system for crypto projects that sell assets through investment contracts.<\/span><\/p>\n

Atkins laid out four main categories for digital assets: \u201cdigital commodities\u201d or \u201cnetwork tokens,\u201d \u201cdigital collectibles,\u201d \u201cdigital tools,\u201d and \u201ctokenized securities.\u201d<\/span><\/p>\n

He made it clear that tokenized versions of traditional financial products \u201care and will continue to be securities.\u201d<\/span><\/p>\n

He also noted that investment contracts \u201ccan come to an end,\u201d meaning a token once issued under that framework isn\u2019t automatically a security forever. \u201cFraud is fraud,\u201d he said, adding that enforcement efforts would continue even as the agency works on new rules.<\/span><\/p>\n

The policy discussion comes as Congress considers broader legislation to define how the SEC and the Commodity Futures Trading Commission divide responsibility for overseeing the crypto market.<\/span><\/p>\n

A <\/span>new draft<\/span><\/a> from Senate Agriculture leaders this week would give the CFTC primary oversight of most non-security tokens.\u00a0<\/span><\/p>\n

The proposal mirrors the House\u2019s earlier CLARITY Act, which outlines a similar framework for defining digital assets.\u00a0<\/span><\/p>\n

The White House, meanwhile, has advocated for a taxonomy-based system in its own digital assets plan.<\/span><\/p>\n

SEC official Atkins said the agency\u2019s work is designed to complement, not replace, Congress\u2019s efforts. Industry groups have spent much of 2025 calling for clearer boundaries and practical compliance paths.<\/span><\/p>\n
