By November 2025, that number had surged to $333.5 million.<\/p>\n<p>There are over 45,000 Bitcoin ATMs across the US allowing users to <a href=\"https:\/\/bitcoinist.com\/us-stablecoin-legislation-issues-and-challenges\/\" target=\"_blank\" rel=\"noopener \">convert cash into crypto<\/a> and send it to wallets globally. However, once the money is sent, experts warn that recovery is nearly impossible, making the machines appealing tools for fraudsters.<\/p>\n<p>\u201cRequesting crypto is now the No. 1 preferred method of criminals,\u201d stated Amy Nofziger, director of fraud victim support at AARP (formerly American Association of Retired Persons), in an October interview with ABC News. \u201cIt is a huge problem.\u201d<\/p>\n<p>Law enforcement has taken notice of the escalating fraud. In September, the attorney general\u2019s office in Washington, D.C., filed a lawsuit against Athena Bitcoin, a major provider of Bitcoin ATMs in the country. <\/p>\n<p>The suit alleges the company pocketed \u201chundreds of thousands of dollars in undisclosed fees on the backs of scam victims.\u201d 93% of the <a href=\"https:\/\/bitcoinist.com\/crypto-witnesses-net-capital-flow-below-4-5-billion\/\" target=\"_blank\" rel=\"noopener \">transactions <\/a>made through Athena\u2019s machines in the district were allegedly linked to outright fraud, with victims often being older individuals, the median age being 71.<\/p>\n<p>Athena Bitcoin has strongly refuted these allegations, stating that it implements robust safeguards against fraud, including clear instructions and consumer education.\u00a0The company also remarked, \u201cJust as a bank isn\u2019t held responsible if someone willingly sends funds to someone else, Athena does not control users\u2019 decisions.\u201d<\/p>\n<h2>17 States Move To Regulate Or Ban Bitcoin ATMs\u00a0<\/h2>\n<p>In response to the rising tide of scams, AARP has called for <a href=\"https:\/\/bitcoinist.com\/ethereum-developers-set-sights-hegota-2026-upgrade\/\" target=\"_blank\" rel=\"noopener \">stricter regulations<\/a> on Bitcoin ATMs, suggesting measures such as daily deposit caps to protect consumers.\u00a0<\/p>\n<p>At least 17 states have enacted legislation in recent years to regulate these Bitcoin ATM machines in the country, while some local governments have moved toward banning them entirely.<\/p>\n<p>New Jersey state Senator Paul Moriarty, who sponsored a bill to prohibit Bitcoin ATMs in the state, <a href=\"https:\/\/edition.cnn.com\/interactive\/2025\/10\/us\/crypto-atm-scams-companies-profit-invs-vis\/\" target=\"_blank\" rel=\"noopener nofollow\">expressed <\/a>strong concerns regarding their impact.\u00a0<\/p>\n<p>\u201cThese machines are nothing more than conduits for fraud and criminal activity. Period,\u201d he stated. \u201cThere\u2019s no other use for them, because if you wanted to buy cryptocurrency you could buy it somewhere else for less.\u201d<\/p>\n<p>In defense of their operations, companies like Bitcoin Depot have stated that while scams do occur, they represent only a small portion of overall transactions.<\/p>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"size-medium\" src=\"https:\/\/www.tradingview.com\/x\/nENKEIl7\/\" alt=\"Bitcoin\" width=\"1814\" height=\"928\"><\/p>\n<p>At the time of writing, Bitcoin was trading at $88,613, marking a slight gain of 1.5% in the past 24 hours and 2% in the past seven days.
