It all started in December 2020 when the agency sued the company, its CEO Brad Garlinghouse, and co-founder Chris Larsen, <\/span><span data-preserver-spaces=\"true\">accusing them<\/span><span data-preserver-spaces=\"true\"> of illegally raising more than $1.3 billion in an unregistered securities offering by selling XRP.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The<\/span><span data-preserver-spaces=\"true\"> two entities have been <\/span><span data-preserver-spaces=\"true\">throwing punches at each other in the following years<\/span><span data-preserver-spaces=\"true\">, and despite <\/span><span data-preserver-spaces=\"true\">the<\/span><span data-preserver-spaces=\"true\"> numerous developments and court rulings, the case remains ongoing.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">According to John Deaton (an American lawyer representing thousands of XRP investors in the <\/span><span data-preserver-spaces=\"true\">aforementioned lawsuit<\/span><span data-preserver-spaces=\"true\">), the SEC \u201cplayed dirty\u201d and pushed \u201cethical limits\u201d in the process. He <a href=\"https:\/\/x.com\/JohnEDeaton1\/status\/1876804290393559450?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1876804290393559450%7Ctwgr%5Eca6086336c5222ea4bc245f80d69a8b8aeb97b20%7Ctwcon%5Es1_&amp;ref_url=https%3A%2F%2Fcoinpedia.org%2Fnews%2Fripple-vs-sec-deaton-claims-sec-used-dirty-tactics-harassed-ripples-customers-and-garlinghouses-family%2F\" data-wpel-link=\"external\" target=\"_blank\">claimed<\/a> that the Commission\u2019s attorneys \u201cengaged in abusive discovery tactics, threatening and harassing Ripple\u2019s overseas customers, investors, and partners.\u201d<\/span><\/p>\n<blockquote>\n<p><span data-preserver-spaces=\"true\">\u201cDespite having the records of every XRP transaction made by Garlinghouse, the SEC attempted to subpoena all of Brad\u2019s, and his family\u2019s, personal financial records, including credit card statements. It was an attempt to bully, threaten, and coerce Garlinghouse (and Ripple) into submitting to the <\/span><span data-preserver-spaces=\"true\">all powerful<\/span><span data-preserver-spaces=\"true\"> SEC,\u201d he added.<\/span><\/p>\n<\/blockquote>\n<p><span data-preserver-spaces=\"true\">Deaton, though, maintained that the company\u2019s CEO endured the pressure, fought back \u201cevery step of the way,\u201d and eventually won.\u00a0<\/span><\/p>\n<blockquote>\n<p><span data-preserver-spaces=\"true\">\u201cI love America because two years and one <\/span><span data-preserver-spaces=\"true\">Presidential<\/span><span data-preserver-spaces=\"true\"> election later, the future couldn\u2019t look <\/span><span data-preserver-spaces=\"true\">more<\/span><span data-preserver-spaces=\"true\"> bright<\/span><span data-preserver-spaces=\"true\"> for an industry, company and CEO,\u201d the lawyer concluded.<\/span><\/p>\n<\/blockquote>\n<p><span data-preserver-spaces=\"true\">It is worth mentioning that Deaton\u2019s post was <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/x.com\/bgarlinghouse\/status\/1876783603603939438\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"external\"><span data-preserver-spaces=\"true\">accompanied<\/span><\/a><span data-preserver-spaces=\"true\"> by a photo of Garlinghouse, the newly elected president of the USA, Donald Trump, and Ripple\u2019s CTO Stuart Alderoty, who recently had dinner together. The XRP army interpreted this gathering as good news for the firm\u2019s potential growth in the near future and the performance of its native token.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Earlier this month, Garlinghouse <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/cryptopotato.com\/brad-garlinghouse-applauds-trump-effect-as-ripple-gains-ground-in-us-deals\/\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\"><span data-preserver-spaces=\"true\">credited<\/span><\/a><span data-preserver-spaces=\"true\"> the substantial resurgence of the cryptocurrency market to Donald Trump\u2019s win in the presidential elections. He said Ripple signed more US deals in the final six weeks of the year than in the previous six months, while 75% of the firm\u2019s open positions <\/span><span data-preserver-spaces=\"true\">are now based<\/span><span data-preserver-spaces=\"true\"> in America.<\/span><\/p>\n<h2><span data-preserver-spaces=\"true\">Has Ripple Won the Case?<\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">While the company notched several partial court wins, a final <\/span><span data-preserver-spaces=\"true\">resolution of the lawsuit<\/span><span data-preserver-spaces=\"true\"> has yet to <\/span><span data-preserver-spaces=\"true\">be seen<\/span><span data-preserver-spaces=\"true\">. Last summer, Judge Analisa Torres\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/cryptopotato.com\/ripple-fined-125m-in-lawsuit-against-sec-xrp-price-soars-20-immediately\/\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\"><span data-preserver-spaces=\"true\">ordered<\/span><\/a><span data-preserver-spaces=\"true\"> Ripple to pay a $125 million civil penalty for violating federal securities laws through its institutional sales of XRP. <\/span><\/p>\n<p><span data-preserver-spaces=\"true\">It is important to note that in 2023, the same magistrate found that the firm\u2019s programmatic sales of XRP to retail clients through centralized exchanges did not breach the rules.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Ripple respected the decision and was ready to pay the fine. After all, it represented just a fraction of the $2 billion the SEC initially requested.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">However, the watchdog officially <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/cryptopotato.com\/sec-provides-details-with-last-minute-appeal-in-ripple-xrp-ruling\/\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\"><span data-preserver-spaces=\"true\">appealed<\/span><\/a><span data-preserver-spaces=\"true\"> in October, delaying the outcome indefinitely. The upcoming changes in the SEC\u2019s leadership, <\/span><span data-preserver-spaces=\"true\">such as replacing Chairman Gary Gensler with the pro-crypto Paul Atkins<\/span><span data-preserver-spaces=\"true\">, may result in a favorable resolution for Ripple.
