Coinbase SEC: Narrow Appeal Could Shape the Future of Crypto<\/h2>\n

Judge Katherine Polk Failla of New York\u2019s Southern District signed off on Coinbase\u2019s request to take a narrow legal question to the Second Circuit Court of Appeals.<\/p>\n

The focus was whether the SEC had stretched the boundaries of the 1946 Howey Test<\/a> to fit cryptocurrencies. This ruling stalls the broader SEC case accusing Coinbase of running an unregistered exchange, broker, and clearing agency.<\/p>\n
