Recall that the regulator\u2019s Chairman, Gary Gensler, officially <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/cryptopotato.com\/gary-gensler-officially-out-what-does-it-mean-for-ripple-xrp\/\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\"><span data-preserver-spaces=\"true\">stepped down<\/span><\/a><span data-preserver-spaces=\"true\"> on January 20 and was replaced by crypto proponent Mark Uyeda.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The Commission has <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.sec.gov\/newsroom\/meetings-events\/sunshine-act-notice-closed-012325\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"external\"><span data-preserver-spaces=\"true\">scheduled<\/span><\/a><span data-preserver-spaces=\"true\"> its first closed meeting under the new Acting Chairman for January 23, causing the XRP Army to speculate that the case against Ripple might be on the agenda this time. Some of the most optimistic predictions <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/x.com\/DrewV2323\/status\/1881807041867698554\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"external\"><span data-preserver-spaces=\"true\">include<\/span><\/a><span data-preserver-spaces=\"true\"> a dismissal of the lawsuit.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">It is worth mentioning that the SEC conducts such meetings quite frequently, and there are no public records showing that it has touched upon the aforementioned legal tussle in any of them.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Marc Fagel<\/span><span data-preserver-spaces=\"true\"> \u2013 <\/span><span data-preserver-spaces=\"true\">a former regional director of the SEC for the San Francisco office<\/span><span data-preserver-spaces=\"true\"> \u2013 <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/x.com\/Marc_Fagel\/status\/1881809007662546946\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"external\"><span data-preserver-spaces=\"true\">claimed<\/span><\/a><span data-preserver-spaces=\"true\"> that those expecting \u201csomething monumental to happen\u201d <\/span><span data-preserver-spaces=\"true\">at<\/span><span data-preserver-spaces=\"true\"> the upcoming gathering \u201care about to be disappointed.\u201d<\/span><\/p>\n<blockquote>\n<p><span data-preserver-spaces=\"true\">\u201cThis is the same meeting they hold nearly every week. They will vote on recommendations calendared weeks ago,\u201d <\/span><span data-preserver-spaces=\"true\">he<\/span><span data-preserver-spaces=\"true\"> assumed.\u00a0<\/span><\/p>\n<\/blockquote>\n<h2><span data-preserver-spaces=\"true\">Not so Fast<\/span><\/h2>\n<p><span data-preserver-spaces=\"true\">The anti-crypto Gensler might be out of the SEC, but the official resolution of the case against Ripple remains challenging. After all, the entities have been confronting each other in court for over four years, throwing punches at each other on every possible occasion.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The core issue in the lawsuit is whether XRP (Ripple\u2019s native token) should be classified as a security. The SEC argues it was sold as an unregistered investment, while the company insists it is a digital asset used for payments <\/span><span data-preserver-spaces=\"true\">and <\/span><span data-preserver-spaces=\"true\">not subject to securities laws.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">In 2023, Judge Analisa Torres <\/span><a class=\"editor-rtfLink\" href=\"https:\/\/cryptopotato.com\/xrp-price-explodes-16-as-judge-rules-in-favor-of-ripple-in-sec-case\/\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\"><span data-preserver-spaces=\"true\">ruled<\/span><\/a><span data-preserver-spaces=\"true\"> that XRP sales on public exchanges to retail investors did not constitute securities transactions.
